The petitioner is apprehending his arrest in connection with Bisfi (Patauna) P.S.Acse No.287 of 2018 registered for offences punishable under Sections 409, 420, 466, 467, 468/34 of the Indian Penal Code.
As per FIR, petitioner had been allotted the work of NalJal Yojna, he has been given a cheque of Rs.50,000/- and by manipulation he has withdrawn Rs.7,50,000/-. It further appears from the FIR that an inquiry has been conducted and in inquiry also the allegation was found true.
Submission of the learned counsel for the petitioner is that there is whatever allegation this is against one Amit Kumar who is brother of the petitioner and not against the
Patna High Court CR. MISC. No.49312 of 2019(4) dt.25-10-2019 2/2 petitioner.
Heard learned A.P.P. , who has opposed the prayer for bail..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of the materials available on the record.
With the aforesaid direction, this application is dismissed.
