The petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a)/41(1) of the Bihar Prohibition and Excise Act, 2016.

Nepali liquor was recovered from a pickup van. It is alleged that the petitioner is a driver of the pickup van. While fleeing, her was arrested.

Submission is that neither the petitioner was arrested on spot nor recovery was made from his possession. He is in custody since 21.05.2019. Investigation of the case is already complete.

Considering the aforesaid facts, let the petitioner,

Patna High Court CR. MISC. No.50601 of 2019(2) dt.22-08-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kundwa Chainpur P.S. Case No.68 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
