JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioners and the State. Petitioners seek bail in a case instituted for the offence under Sections-307, 353 and 34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that when the informant went to arrest both these petitioners who are accused in Basantpur P.S. Case No. 168 of 2016, both the petitioners fired on police party though no one sustained injury and thereafter, petitioners fled away. There is no recovery of cartridges. Petitioners are said to be in custody since 09-09-2016.
Considering the above-said facts and circumstances of the case, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two
Patna High Court Cr.Misc. No.4415 of 2017 (2) dt.13-02-2017 2/2 sureties of the like amount each in connection with Basantpur P.S. Case No. 168 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan subject to condition that both the bailors will be close relatives of the petitioners.
