JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bahadurpur P.S. Case No. 121 of 2019 registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307, 504, 509, 379 and 427 of the Indian Penal Code.
Prosecution story is that while the informant and his brother were returning to the house accused persons caught them and confined in a room and also assaulted them. It is also alleged that they were demanding Rs.2 lac.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and allegation of demand is false and concocted and as a matter of fact mar pit took place between the parties and there is no specific allegation of assault against the petitioner and co-

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S. Case No. 121 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
