JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajgir P.S. Case No. 203 of 2019 registered for the offences punishable under Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.
Prosecution story is that police intercepted one motorcycle and caught one accused and others succeeded in fleeing away and from the apprehended person one loaded pistol was recovered, who disclosed the name of the petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated on the basis of disclosure made by co-accused and he has no criminal antecedent. Heard learned APP also.
In view of above facts and circumstances, this application is disposed of with direction to the court below to
Patna High Court CR. MISC. No.49758 of 2019(2) dt.08-08-2019 2/2 verify the criminal antecedent of the petitioner and if he has no criminal antecedent, on surrender he shall be released on bail to the satisfaction of the court below itself, otherwise petitioner to surrender and pray for regular bail.
