JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioners are apprehending their arrest in connection with Complaint Case No. 1114(C) of 2012 for the offences instituted under Section 420 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the petitioners by taking into confidence has brought the informant and his witness to the registry office and got executed land measuring 145 dhurs with consideration money of Rs. 2,50,000/- which was also not paid by manipulating in the paper of deed in connivance with deed writer and when it came to the knowledge of the complainant, he

Patna High Court Cr.Misc. No.29181 of 2015 (2) dt.27-07-2015 2/2 has filed petition for cancellation of sale deed also. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the matter relates to civil nature and there is a Title Suit No. 217/2012 pending in the court below.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1114(C) of 2012 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
