JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hawai Adda P.S.Case No. 167 of 2018 registered under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code.
It is alleged against the petitioner that he participated in the counselling for admission in I.T.I.C.A.T-2018 impersonating himself to be Ajay Kumar. He appears to have accepted his misconduct before the authorities conducting the counselling. Learned counsel appearing on behalf of the petitioner submits that petitioner has been in custody since 30.08.2018 and there is no chance of his fleeing away from the course of investigation or trial, if granted bail. He also submits that no tangible purpose would be served if the petitioner is compelled
Patna High Court Cr.Misc. No.61988 of 2018(2) dt.06-10-2018 2/2 to remain in jail in view of the fact that the case of the prosecution is based on document and there is no chance of tampering with the evidence.
Considering the above submission, this application is allowed. The petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Hawai Adda P.S. Case No. 167 of 2018.
