The petitioner seeks bail in Buniyadganj P.S. Case No. 62 of 2019, instituted for the offence under Section(s) 302 of Indian Penal Code and Section 27 of the Arms Act. In the written report it is alleged that informant heard sound of firing. She came out from house and saw one person wearing white shirt running away. She found her husband lying on the ground with gun shot injury. He was taken to Hospital, but he subsequently died.

Counsel for the petitioner submits that petitioner is not named in the written report. His name has come merely on suspicion due to enmity.

Petitioner is in custody since 25.6.2019 having

Patna High Court CR. MISC. No.49887 of 2019(2) dt.17-08-2019 2/2 clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Gaya, in connection with Buniyadganj P.S. Case No. 62 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
