Petitioner is apprehending arrest in connection with Complaint Case No. 1205(C) /2014 for the offence under Sections 322, 379 and 452 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner is devar of the complainant. Allegation against the petitioner is that he has forcibly ousted the informant from her house and took away all utensils, cloth as well as ornaments. Considering the fact that the complainant is bhavi and the petitioner is devar and the petitioner has no criminal antecedent, this application is allowed.
Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the
Patna High Court Cr.Misc. No.68196 of 2018(2) dt.14-12-2018 2/2 petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate 1st, Danapur in connection with Complaint Case No. 1205 (C)/2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and on the condition that he will pay respect and behave with dignity with informant and any further complaint of the informant of continuing misbehaviour shall be viewed seriously.
