JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is that he along with other accused persons has killed brother of informant as the deceased had love affair with the daughter of co-accused Imran Mian. It has been submitted on behalf of petitioner that he is in custody since 15.9.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses against petitioner. Petitioner has been named in the F.I.R. merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest implication of petitioner in the present case.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.51337 of 2016 (2) dt.05-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IIIrd, Bettiah, West Champaran, in connection with Sikta P.S. Case no. 75 of 2015.
