Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 308, 379 and 504/34 of the Indian Penal Code, registered in connection with Sono (Charkapathar) P.S.Case No. 141 of 2022.

As per allegation, the petitioner and his mother Usha Devi (co-accused) came to the house of the informant. There is specific allegation that the petitioner inflicted rod blow on the head of the informant.

Patna High Court CR. MISC. No.52534 of 2022(3) dt.24-01-2023 2/2 The learned counsel for the petitioner has submitted that he is innocent and the informant is the uncle of the petitioner. The FIR has been lodged after three days of the occurrence.

On the other hand, the learned APP has opposed the prayer for anticipatory bail.

From perusal of the impugned order, it appears that the informant has suffered grievous injury on his head, which is specifically attributed against the petitioner. In my view, it is not a fit case for anticipatory bail to the petitioner. It is accordingly rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
