JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and informant has admitted that relation of petitioner with deceased was cordial and it were other in laws of the deceased, who used to torture her. Moreover, in course of investigation, some witnesses stated that deceased committed suicide and the police has submitted charge sheet under Section 306 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.46002 of 2016 (3) dt.02-12-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 51 of 2016.
