ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Wazirganj P.S.Case No. 187 of 2015 registered under Sections 448, 341, 323, 379, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire allegation is false and mischievous and has been engineered by the informant to evade execution of the sale deed for which he had received some money. Learned counsel further submits that there is a case and counter case between the parties. Learned counsel for the State after perusal of the case diary submits that apparently there was some dispute regarding sale and purchase of the land for which money had exchanged

Patna High Court Cr.Misc. No.29149 of 2015 (3) dt.05-10-2015 hands but in view of the fact that such dispute can well be resolved by a court of civil jurisdiction, there is no reason why the present case ought to have been executed making allegations and counter allegations.

Considering the aforementioned facts and circumstances, there being no cogent material in the case diary and also because the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Wazirganj P.S.Case No. 187 of 2015 to the satisfaction of the Chief Judicial Magistrate, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
