Petitioner, who is in custody, seeks bail in connection with Raxaul P.S. Case No. 221 of 2018 registered for the offences punishable under Sections 382, 411 and 34 of the Indian Penal Code and 37(b) of the Bihar Prohibition and Excise Act.
Informant has alleged that when she was watching T.V. in her room petitioner along with other co-accused came into her angan and stole mobile and cash from her godrej and when she went into the room they fled away after pushing her but were caught by local people and petitioner was also found in drunken state.
Patna High Court Cr.Misc. No.65761 of 2018(2) dt.30-10-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion. No theft article has been recovered from his possession. He has no criminal antecedent. He is in custody since 15.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran in connection with Raxaul P.S. Case No. 221 of 2018.
