The petitioner has preferred this application for grant of regular bail in a case registered under sections 498A and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

As per the prosecution case, the informant states that she was married to the petitioner herein in the year 2016. The accused persons including the petitioner herein subjected the informant to cruelty for non-fulfillment of the demand of dowry to the tune of Rs.3 lacs and ultimately she was forced out of the house.

It is submitted by learned counsel for the petitioner that the petitioner happens to be the husband of the informant.

Patna High Court CR. MISC. No.62690 of 2021(2) dt.12-04-2022 2/2 He has been falsely implicated in the case. The allegations levelled in the F.I.R. are false and incorrect. He is in custody since 25.8.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for more than 7 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Raxaul P.S. Case no.340 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran.
