JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kochas (Parsathua) P.S. Case No. 32 of 2012, registered under Sections 302, 207 & 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is renewing his prayer for bail in the light of order dated 10.02.2016 passed in Criminal Miscellaneous No. 762 of 2015, whereby the prayer for bail of the petitioner was rejected with observation that if the trial of the petitioner is not concluded within a period of six months, the petitioner may renew his prayer for bail.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.38899 of 2016 (3) dt.28-09-2016 2/2 petitioner is in custody since 17.09.2012.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 7th Addl. Sessions Judge, Rohtas at Sasaram in connection with Kochas (Parsathua) P.S. Case No. 32 of 2012. The petitioner will file undertaking to the effect that he will appear before the trial court on each and every date. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
