JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hussainganj P.S. Case No. 263/2018 registered for the offences punishable under Sections 30(A) and 36 of the Bihar Prohibition and Excise Act, 2016.

Three litres country-made liquor were recovered from the roof of the house of the petitioner.

Submission on behalf of the petitioner is that the seizure list does not bear the signature of any family members of the petitioner and petitioner does not have any criminal antecedents, but I am not convinced with the aforesaid submission and, accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
