2. Petitioner seeks regular bail in connection with Sarsi P.S. Case No. 16 of 2025 dated 31.01.2025 registered for the offences punishable under sections 80, 238 and 3(5) of the Bharatiya Nyaya Sanhita.

3. The main submissions advanced by petitioner's counsel are that the petitioner is not named in the FIR, the main allegation is against the deceased's husband, namely, Rajdeep Yadav and his close family members while the petitioner is cousin brother-in-law (mausera bhanoi) of the husband of the deceased and he has been made accused in this case mainly on

No.50506 of 2025(2) dt.11-08-2025 2/3 account of his conversation with the named accused Mithilesh Yadav on mobile phone and except this, there is no allegation against this petitioner and no one has claimed to have seen this petitioner being involved in the commission of the alleged murder. It is lastly submitted that the petitioner has been languishing in jail since 18.03.2025, having fair and clean antecedent and against him, the investigation has been completed.

4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the facts that the petitioner is not named in the FIR and during the course of investigation, he has been made accused mainly on the basis of suspicion being raised on account of his conversation on the mobile phone with the co-accused Mithilesh Yadav, who happens to be his relative, and except this, the prosecution has not pointed out any material appearing against this petitioner, coupled with his custody period, fair and clean antecedent and completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two
