JUSTICE SANJAY PRIYA ORAL ORDER 02-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khagaria P.S. Case No. 32 of 2016 instituted for the offence under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that informant saw the crowd of co-villagers. Thereafter, the petitioner reached near the well and found the dead body inside the well. Counsel for the petitioner submits that First Information Report has been lodged against unknown. The police during investigation has arrested one Deepak Yadav who disclosed the name of this petitioner. Counsel for the petitioner further submits that Deeapk Yadav has been granted bail by coordinate Bench of this Court vide order dated 17.11.2016

Patna High Court Cr.Misc. No.66241 of 2018 (2) dt.02-11-2018 2/2 passed in Cr. Misc. 38234 of 2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 32 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
