JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-06-2018 This anticipatory bail application arises out of Complaint Case No. 603 of 2013, alleging offences under Sections 406, 465, 467, 468, 471 and Section 34 of the Indian Penal Code.

The complainant was father of petitioner no. 2 and father-in-law of petitioner no. 1. It is alleged against petitioners no. 1 and 2, that they fraudulently got prepared a panchayatnama in respect of partition of properties belonging to the complainant.

Notices were issued to the complainant as opposite party no. 2. It appears from the service record that the complainant opposite party no. 2 has died.

Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.46455 of 2017(5) dt.27-06-2018 2/2 petitioners, has submitted that it is apparent on reading of the complaint case that the dispute is of civil nature. It has also been submitted that there is no chance of the petitioners absconding from trial, if required.

Considering the above submission, this application is allowed. The provisional bail granted to the petitioners stand confirmed.
