Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The accusation is killing the pregnant daughter of the informant after one year of marriage. It is submitted by learned counsel for the petitioner that petitioner is brother of the husband of the victim and on conclusion of investigation the petitioner was not sent up for trial but differing with the final form, cognizance was taken against the petitioner under Section 302 of the Indian Penal Code. The petitioner claims to be separate from the husband of the victim. It is further submitted that husband of the victim is in custody and non-sent up co-accused have been

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera at Samastipur in connection with Hathauri P.S. Case No. 85 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
