The petitioners seek bail in a case instituted under Sections 461 and 379 of the Indian Penal Code. It is alleged that some unknown persons have committed theft in the shop of the informant after drilling the back portion of the wall of the shop and looted several articles from the shop total worth Rs. 6 lac.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 18.02.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The

There is no recovery of any incriminating article from the possession of the petitioners. The petitioners have been made accused on the basis of confessional statement of co-accused. The other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, in connection with Nawada Town P.S. Case No. 799 of 2015.
