Petitioner seeks bail in Jokihat P.S. Case No.136 of 2018 instituted for the offence under Section(s) 379 and 414 Indian Penal Code.
In the written report, it is alleged that informant had gone to Adarsh Book Point after parking his motorcycle and returned after 30 minutes. He found his motorcycle was not present there. The informant started searching his motorcycle and found one person going on his motorcycle. He caught hold that person, who disclosed his name as petitioner. The petitioner along with motorcycle was handed over to the police. Counsel for the petitioner submits that petitioner has
Patna High Court Cr.Misc. No.65165 of 2018 (2) dt.02-11-2018 2/2 been implicated in this case due to enmity. In the written report itself, it is mentioned that petitioner was handed over to the police by the informant.
Petitioner is in custody since 20.05.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Jokihat P.S. Case No.136 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
