ANJANA MISHRA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire family members including the minor children in the house have been made accused in this case. He further submits that the husband of the deceased is already languishing in custody and petitioner No. 1 and 2 are the brother-in-law (Dewar) of the deceased whereas petitioner No. 3 is the mother-in-law and
Patna High Court Cr.Misc. No.29398 of 2015 (3) dt.15-09-2015 P2/2 petitioner No. 4 is the minor sister of the husband of the deceased. Considering the nature of allegations made against the petitioners and there being general and omnibus allegations against them, let the petitioners, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia P.S. Case No. 727/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
