Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34, 120 (B) of the Indian Penal Code and Section 27 of the Arms Act. According to F.I.R., informant saw that all the nine accused persons, including the petitioner started indiscriminate firing on his brother. Specific allegation is that shot fired by Binay Sah hit the chest of the brother, who fell down. Thereafter, co-accused, Swet Kumar Mahot @ Mahanth and Sushil Singh also fired with the pistol, causing injury at his head. The doctor has found single firearm wound of entry and exit at the left chest and single firearm wound of entry and exit at the left temporal region.

No.49393 of 2019(2) dt.13-08-2019 2/2 Since the specific allegation consistent with the medical report is against some other co-accused and no other injury was found on the person of the deceased, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bakhri Police Station Case No.14 of 2018, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
