The petitioner seeks bail in Bihta P.S. Case No. 563 of 2019, registered for the offences punishable under Sections 143, 447, 341, 323, 353, 307, 504 and 506 of the Indian Penal Code.

Informant alleged that on 14.06.2019 at 3.00 p.m., the petitioner along with 8 to 10 unknown persons came at Power House, Bihta and assaulted the informant on his head with iron rod causing head injury. They also abused other staffs and assaulted them.

It is submitted on behalf of the petitioner that there is no specific allegation against this petitioner. Petitioner has falsely been implicated in this case. In fact, due to non-supply of electricity, the villagers had gone to the Power House for

Patna High Court CR. MISC. No.48445 of 2019(3) dt.20-09-2019 2/2 making enquiry about power supply and some hot exchange of words taken place between the informant and villagers. Injury caused to the informant is simple in nature.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Danapur, Patna in connection with Bihta P.S. Case No. 563 of 2019 subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.

(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Prabhat Kumar Singh, J) vinita/- U T
