Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 414, 413, 120(B) and 34 of the Indian Penal Code, registered in connection with Sono P.S.Case No. 196 of 2022.

As per allegation, three motor-cycles were recovered from the house of co-accused Dharmendra Kumar Sao which are said to be stolen ones.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.52226 of 2022(2) dt.23-01-2023 2/2 submitted that the petitioner is innocent. He is a person of clean antecedent and there is allegation that he had purchased one motor-cycle from Dharmendra Kumar Sao.

On the other hand, the learned APP has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pranav Kumar, J.M. 1st Class, Jamui in connection with Sono P.S.Case No. 196 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
