JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 47(a), 54, 57 of Bihar Excise (Amendment) Act, 2016.

Taking into consideration that in huge quantity liquor was recovered from the tractor of the petitioners and petitioners were caught with the aforesaid liquor and tractor, I am not inclined to release the petitioners on bail, at least at this stage and hence, their prayer for bail in connection with Pranpur (Rosana) P.S. Case No. 74 of 2016 pending in the court of Additional Chief Judicial Magistrate-I, Katihar stands rejected.
