The petitioner seeks bail in anticipation of his arrest in connection with Saraiya P.S. Case No. 792 of 2019 instituted for the offences under Sections 376, 420, 504, 506 and 34 of the Indian Penal Code.

Regard being had to the nature of accusation against the petitioner of having agreed to marry the informant and thereafter subjecting her to sexual intercourse but refusing to marry later on account of non-payment of dowry, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail is rejected.

No.9346 of 2021(2) dt.20-12-2021 2/2 However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
