JUSTICE ARUN KUMAR ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. Allegation in brief is that this petitioner and his brother Md. Rizwan introduced the informant to so-called Md. Anas but Md. Jiyaul Haque was impersonating as Md. Anas and Md. Rizwan received the consideration money and sale deed was got executed in favour of the informant which was later on found forged as alleged. Md. Rizwan and Rampukar Paswas identified the vender and are witness on sale deed.

Learned counsel for the petitioner submits that there is no allegation against the petitioner except that he introduced the informant to the vender Md. Anas, neither he had received the

Patna High Court Cr.Misc. No.53699 of 2016 (2) dt.14-12-2016 2/2 consideration money nor identifying witness to the sale deed. It is further submitted that Md. Rizwan and Rampukar Paswan have been granted anticipatory bail by a Co-ordinate Bench of this Court by order dated 28.4.2016 passed in Cr. Misc. No.14519 of 2016. It appears that the case of the petitioner stands on a better footing to Md. Rizwan and he is in custody since 8.8.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Darbhanga in connection with Laheriasarai P.S. Case No.441 of 2015.
