JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is claimed by the prosecution that 28.4 litres Nepali liquor and one motorcycle were recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that having similar allegation, co-accused Shankar Yadav @ Shekhar Yadav has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated 29.10.2018 passed in Cr. Misc. No. 64798 of 2018.

No.65938 of 2018(2) dt.22-11-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise Act, Madhubani in connection with Deodha P.S. Case No. 92 of 2018.
