2. The petitioner is languishing in custody since 18.04.2026, registered offences U/s- 318(4), 338. 336(3), 340(2), 352, 351(2), 351(3), 3(5) of BNS and is seeking regular bail in connection with Hajipur Sadar P.S Case No. 130 of 2026.
3. The allegation against the accused persons in the FIR is that accused along with petitioner in the name of buying and selling of land, they were creating fake land deeds.
4. Learned counsel for the petitioner submits that he is only identifier on the sale deed and as such he had no knowledge of this fact that such irregular acts were being committed by the co-accused persons. Learned counsel further submits that the Katib /deed clerk of this case namely Anil Kumar Verma has already
Patna High Court CR. MISC. No.51878 of 2026(2) dt.29-07-2026 2/3 been granted bail by learned Court below on 16.04.2026 as mentioned in paragraph 18 of the bail petition. Learned counsel further submits that petitioner is in custody since 18.04.2026 having one case against him, he undertakes not to repeat the offence.
5. Learned APP on behalf of the State has opposed the application.
6. Taking into consideration that petitioner happens to be identifier and one of the co-accused/Katib/deed clerk has already been granted bail, the prayer for bail is allowed and the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned court of C.J.M Vaishali at Hajipur/concerned court in connection with Hajipur Sadar P.S Case No. 130 of 2026, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial. (ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister or wife. (iii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if he is found involved in any other case except mentioned in para 3 of the bail petition, his bail bond shall not be accepted. (iv) The petitioner will appear on each and every date
Patna High Court CR. MISC. No.51878 of 2026(2) dt.29-07-2026 3/3 fixed by the trial court and if, he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
(v) It is also made clear that there shall not be any delay in verifying the criminal antecedent of the petitioner. (vi) If he repeats any offence of similar nature, his bail bond shall be liable to be cancelled immediately by the learned court below.
