Petitioners seek bail in a case registered under section 302 and other minor sections of the Indian Penal Code. Petitioners are named in the first information report but no specific overt-act has been attributed against them rather it is stated that they along with co- accused Lal Babu Rai and other assaulted the deceased and others. Photo copy of the post mortem report of the deceased has been annexed as annexure 2 to the petition and the aforesaid annexure goes to show that no mark of any injury was found on the person of the deceased and opinion regarding cause of death of the deceased was kept pending till receipt of chemical examination. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on
Patna High Court Cr.Misc. No.44714 of 2016 (2) dt.17-10-2016 furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge III, Patna in Sessions Trial no. 553/2016 arising out of Gopalpur P.S. Case no. 12/2016.
