JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kalyanpur P.S. Case No. 175 of 2018 instituted for the offence under Sections 341, 342, 323, 307, 324, 325, 353/34 of the Indian Penal Code, Sections 30(a) and 45 of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner and other co-accused persons is that they forcibly rescued Bashir Ahmad from custody of the police. They also wrapped Gamchha in the neck of the informant and pushed him on the ground. They began to pull Gamchha in his neck with intention to kill the informant. Thereafter, the other police personnel saved him. Counsel for the petitioner submits that petitioner is in custody since 14.08.2018. There is general and omnibus
Patna High Court Cr.Misc. No.66288 of 2018 (2) dt.06-11-2018 2/2 allegation against the petitioner. Counsel for the petitioner further submits that petitioner has clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Motihari, East Chamapran, in connection with Kalyanpur P.S. Case No. 175 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
