Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Kotwali P.S. Case no. 360 of 2019 registered under sections 307, 379 and other allied section of the Indian Penal Code as well as section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R and his name surfaced during course of investigation and is alleged to be member of the alleged mob and he is student of B.Sc. There is nothing

Patna High Court CR. MISC. No.62698 of 2021(2) dt.09-06-2022 2/2 against the petitioner and he is a person of clean antecedent and some co-accused persons have been granted regular bail. Learned APP opposes the prayer for anticipatory bail. Considering the above mentioned facts and circumstances and also the fact that the prosecution has not drawn attention of the court to any specific role of the petitioner, let the above named petitioner, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case no. 360 of 2019 subject to condition as laid down under section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
