====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 Petitioner prays for bail in connection with G.O. Case No. 67 of 2018, arising out of Darbhanga Town P.S.Case No. 13 of 2018, registered for the offences punishable under Sections 30(a) and 37(c) of Bihar Prohibition and Excise Act, 2016. Allegation as per FIR is of recovery of 277 and odd litres of liquor and petitioner is named in the FIR and he is accused in four other cases also.

Submission of learned counsel for the petitioner is that recovery has not been made from his conscious possession and his name has been disclosed by co-accused. Further submission is that due to enmity with the police the petitioner has been made accused in several cases one after another and he is in custody for three months.

Heard learned APP, who has opposed the prayer for

Patna High Court Cr.Misc. No.65487 of 2018(2) dt.22-11-2018 2/2 bail.

Having heard both sides and in the facts and circumstances and also having criminal antecedents, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to expedite the trial and try to conclude it within a period of four months. Needless to say that petitioner has to co-operate in disposal of trial. If the trial is not concluded within the said period without any laches on the part of the petitioner, learned trial court shall release the petitioner on bail to its own satisfaction. With the above observation, this application is disposed of.
