JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 26-06-2018 Though, the instant application has been filed under Section 482 of the Code of Criminal Procedure, the same is in the nature of second revision which is barred under Section 397(3) of the Cr.P.C. Moreover, I find from the record that the allegations made in the first information report and the materials collected in course of investigation do attract ingredients of the offence under which cognizance has been taken by the learned Magistrate. That apart, the learned Session Judge while disposing of the revision petition discussed the case in detail and the reasons assigned by him for dismissal of the revision petition are well founded.

2. Moreover, on query made by the Court, learned counsel for the petitioners fairly submitted that, by now, the case has already been committed to the Court of Sessions and charges have already been framed.
3. I see no merit in this application. It is dismissed, accordingly.
