Mr.Sanjay Kumar Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 23-02-2022 Petitioner seeks bail in a case registered for the offence punishable under Sections 364(A) of the Indian Penal Code.

Earlier also, petitioner had moved this Court for grant of regular bail which was rejected vide Annexue 1. Informant has alleged that on 06.01.2020 at 5:00 p.m, his son namely, Raman Kumar Thakur @ Chunna proceeded from his shop to his residence on his bike but he could not reach his house. It is further alleged that there was sale proceed of the shop and two mobiles were also with him which were found to be switcheed off. The informant searched his son but he could not be located. The informant suspected that unknown persons have kidnapped his son.

It has come in the case diary that petitioner was

Patna High Court CR. MISC. No.63155 of 2021(4) dt.23-02-2022 2/2 arrested by the police from the place of occurrence which was his residence and he was the person under whom the victim Raman Kumar Thakur was forcibly kept in a room. It has also come during investigation that he was actively involved in abduction of Raman Kumar Thakur.

The name of the petitioner figured at Sl. No.29 of para 363 as suspect in the C.D.R. etc. provided by the technical cell. The complicity of the petitioner has been mentioned in confessional statement of other co-accused persons. Victim boy has also named petitioner as one of the kidnappers and his case is not similarly situated as of Ravi Kumar, who has been granted bail by this Hon'ble Court in Cr. Misc. No.14801 of 2021.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the court below is directed to expedite and conclude the trial within one year from the date of receipt/production of the copy of the order. Sanjay/- (S. Kumar, J) U T
