JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2024 The present writ petition has been filed seeking the following relief:- "1. That the present writ application is in the nature of Certiorari for quashing the order contained in Memo No. 745(4) dated 27.08.2014 under the signature of the Director in Chief, Health Services, Bihar, Patna as contained in Annexure 15 whereby and whereunder the petitioner has been dismissed from his services from the date of
Patna High Court CWJC No.11928 of 2023(2) dt.19-02-2024 2/3 issuance of the order and further for reinstatement of the petitioner on and from the date of termination i.e. on 27.08.2014 and for payment of all the consequential benefit all dues on and from the period of suspension and for the period of 27.08.2014 the date of termination till date of final disposal of the writ application and also for disposal of appeal which is pending before the Additional Chief Secretary Department of Health and Family Welfare on and from 2021 and further for any other relief or reliefs for which the petitioner may found entitled."

At the outset, the learned counsel for the petitioner has limited the prayer made in the present writ petition to issuance of a direction to the appellate authority to dispose off the appeal filed by the petitioner on 10.02.2021, within a stipulated time frame.

The learned counsel for the respondentState submits that in case the aforesaid appeal is still pending, the same would be decided in
Patna High Court CWJC No.11928 of 2023(2) dt.19-02-2024 3/3 accordance with law, within a stipulated time frame, as directed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the appellate authority i.e. the Additional Chief Secretary, Department of Health and Family Welfare, Government of Bihar, Patna to dispose off the aforesaid appeal filed by the petitioner, in case the same is yet to be disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
