1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(1), 32(2), 41, 42(i) (ii) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. Learned counsel for the petitioner submits that petitioner has antecedent of six cases and is in custody since 26.03.2025 and allegation is of recovery of 1818 litres of liquor from a pick-up vehicle. It is next submitted that petitioner is not the owner of the seized vehicle and was not arrested from the place of occurrence rather surrendered subsequently. It is further submitted that since the petitioner has antecedent as such he came to be implicated in the instant case. It is also submitted that similarly situated co-accused have been granted the
Patna High Court CR. MISC. No.55432 of 2025(3) dt.05-12-2025 2/2 privilege of anticipatory bail by this court, as would manifest from Annexure-2 series to the anticipatory bail application.
4. Learned A.P.P. opposes the prayer for bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court-1, Sitamarhi, in connection with Majorganj P.S. Case No.175/2024.
