For issuance of writ in the nature of certiorari for quashing Form 1 (Notice) dated 28-07-2022 under Section 3 of the Bihar Public Land Encroachment Act in Encroachment Case No. 06/2022-23 issued by the Circle Officer, Nuav, Kaimur, whereby and whereunder petitioner has been declared encroachers upon the land bearing Mauza-Dumduma, Thana No. 292, Khata-451, Khesra 2545, Area 0.03 Decimal, P.S.- Kudhni, District-Kaimur and further directed to appear to file
Patna High Court CWJC No.13684 of 2022(2) dt.09-05-2023 2/2 reply.
ii.) For restraining the respondents from alienating the petitioner from the land in question upon which Pucca House of the petitioner is standing since last 50 years.
iii.) For a further direction upon the respondents to stay the proceeding of Encroachment Case No. 06/2022-23 till the final disposal of the case."
Considering the nature of relief sought for in the present writ petition, I deem it fit and proper to grant liberty to the petitioner to approach the respondent-authorities for redressal of his aforesaid grievances. Liberty so sought is granted. The writ petition stands disposed off on the aforesaid terms.
