JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents, brothers and uncle of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after for years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioners that the victim died due to illness and was given proper medical assistance at Sadar Hospital, Chapra from where she was referred
Patna High Court Cr.Misc. No.31277 of 2015 (2) dt.31-07-2015 2/2 to PMCH when she died on way. The petitioners claim to be separate from the husband of the victim.
Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Saran at Chapra in connection with Baniyapur P.S. Case No. 307 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
