Petitioner, who is in custody, seeks bail in connection with Siswan P.S. Case No. 10 of 2017 registered for the offences punishable under Sections 272, 273 and 308 of the Indian Penal Code and under Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation against FIR named accused is of recovery of 18 liters of liquor from the persons who were apprehended by the police at the spot.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to highhandedness of police. Name of the petitioner has surfaced on the basis of confessional

Patna High Court Cr.Misc. No.67378 of 2018(2) dt.27-11-2018 2/2 statement made by apprehended persons and nothing has been from the possession of the petitioner. He is in custody since 25.06.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cum-Speical Judge, Excise, Siwan in connection with Siswan P.S.
