Heard the learned counsel for the petitioner as well as Mr. Ram Bilash Roy Raman, the learned APP for the State. The petitioner apprehends his arrest in connection with Choraut P.S. Case No. 66 of 2020, registered for the offences punishable under Sections 379 and 420 of the Indian Penal Code.

As per allegation, the present petitioner along with coaccused, Akhilesh Yadav and one Rahul, while distributing soap to 800 persons, took their Aadhar numbers and finger prints on wax. It is further stated that privacy of 799 persons was stolen. Learned counsel for the petitioner has submitted that

No soaps were distributed by the petitioner and there is no evidence to collect the Aadhar numbers. Moreover, he has paid Rs. 1564/- to Malti Devi and Rs. 40,540/- to Nirmala Devi. He has submitted further that he is a person of clean antecedent. He has also submitted that co-accused Akhilesh Yadav who is father of the present petitioner was granted regular bail by a coordinate Bench of this Court. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Choraut P.S. Case No. 66 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

If it is found that the petitioner is involved in similar nature of case, prior or after passing this order, the learned court below shall be at liberty to cancel his bail bond.
