JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner being husband of the deceased apprehends his arrest in connection with Teghra P.s. Case No. 391 of 2014 registered under sections 302,201 of the Indian Penal Code.
Admittedly the marriage of the deceased had taken place with the petitioner 25 years ago. It is also an admitted position that when the statement of the informant was recorded under section 164 Cr.P.C., he stated that he lodged the present case on wrong information and, as a matter of fact, the deceased committed suicide due to petty family dispute. During investigation, almost all the co-villagers have stated that they took
Patna High Court Cr.Misc. No.14853 of 2015 (3) dt.29-06-2015 out the deceased after breaking open the door of the room. The children of the deceased specifically stated that there was dispute on selling of land to meet the debt and due to the aforesaid reason the deceased committed suicide.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 391 of 2014 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Hemant Kumar Srivastava, J) Amin/- U
