The petitioner apprehends arrest in a case registered for the offences punishable under sections 363 and 365 of the Indian Penal Code.
Wife of the victim made allegation that her husband went along with Sushil Kumar Singh and others but did not return. During course of investigation, the victim was recovered and he disclosed that from the mobile of the petitioner ransom was demanded.
It is submitted that the petitioner lost her mobile during the course of journey. She was not at all involved in the crime. She is a lady and she has got no criminal antecedent.
Patna High Court Cr.Misc. No.34367 of 2015 (3) dt.29-10-2015 Considering the fact that the ransom was demanded from the mobile of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Raxaul Rail P.S. Case No. 22 of 2014 pending in the court of the learned Railway Judicial Magistrate, West Champaran at Bettiah. Her prayer for anticipatory bail is, accordingly, rejected. The petitioner, if so advised, may surrender and pray for regular bail which will be considered by the court below on its own merit without being prejudiced by this order of rejection.
