JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-07-2015 Heard both sides. It is submitted that the petitioner was granted bail by order dated 21.05.2015 passed in Criminal Misc. No. 7125 of 2015 but due to inadvertence in the prayer portion "to the satisfaction of the learned Chief Judicial Magistrate, Sasaram", has been wrongly typed in place of learned Sub-divisional Judicial Magistrate, Dehari, Rohtas or Mr. Devesh Kumar, Judicial Magistrate, 1st Class, Dehri, Rohtas and, therefore, in the order dated 21.05.2015 the petitioner was granted bail to the satisfaction of the 1st Additional District & Sessions Judge, Rohtas at Sasaram. The case is still pending before the court of the Sub-divisional Judicial Magistrate, Dehri.
Accordingly, the petitioner is directed to make
Patna High Court Cr.Misc. No.29437 of 2015 (2) dt.08-07-2015 necessary correction in the prayer portion of the bail application and, accordingly, in the order dated 21.05.2015 the words "to the satisfaction of 1st Additional District and Sessions Judge, Rohtas, will be modified and read as "to the satisfaction of the Subdivisional Judicial Magistrate, Dehri Rohtas or Mr. Devesh Kumar, J. M. 1st Class, Dehri, Rohtas. Order dated 21.05.2015 stands modified to this extent only. This application is, accordingly, allowed.
