JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and it is alleged that petitioner including near about 30 persons went in the house of the informant in search of his son, namely, Pintu Kumar, with whom prior to the alleged occurrence, a quarrel had taken place on account of giving side to the vehicle. When the aforesaid Pintu Kumar was not found present in the house, petitioner and his associates started taking away his elder brother, namely, Bitu Kuamr, which was opposed by the informant but petitioner put katta on the temple of the aforesaid Bitu Kumar and threatened the informant to kill him. However, in the meantime,

Submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and he happens to be student . It is further submitted that, as a matter of fact, some quarrel had taken place prior to the alleged occurrence and the informant in connivance with the local police got implicated the petitioner in this false case. It is further submitted that petitioner is in jail custody since 6.08.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Taraiya P.S.Case No. 173 of 2016.
