JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the first information report and according to first information report, it were co-accused Rewati Ranjan and Manohar Yadav who opened fire on the deceased. However, it is informed that the name of petitioner came in course of investigation in the statement of son of the informant. The petitioner is in jail custody since 20.05.2017 and Annexure 2, the order dated 26.06.2018 passed in Cr. Misc. No. 35499 of 2018, goes to show that co-accused Manohar Yadav

Patna High Court Cr.Misc. No.65928 of 2018(2) dt.22-11-2018 2/2 has already been granted privilege of bail by a co-ordinate Bench of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeIInd, Munger in connection with Sessions Trial No. 294 of 2017 arising out of Nayaram Nagar P.S.
