Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Ekma (Akma) P.S. Case No. 157 of 2022, registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code.
The informant Phulpati Devi, mother of the deceased has made allegation in the FIR that co-accused Anshu Kumar and Shivam Kumar called and took out her son. Later on, six named accused persons killed her son by inflicting repeated
Patna High Court CR. MISC. No.52717 of 2022(4) dt.15-03-2023 2/3 knife blows. In CCTV Footage, it was revealed that the injured was carried to the clinic by WagonR no. 8521. The learned counsel for the petitioner has submitted that he is the owner of the vehicle by which the injured person was carried to the hospital. The witnesses have also stated that he is owner of that vehicle and he is named in the FIR. He has submitted further that the FIR has been lodged after two days of the occurrence and no motive has been assigned against the petitioner for killing of the deceased.
On the other hand, the learned APP as well learned counsel for the informant have submitted that the petitioner is named and he is owner of the vehicle whereby the injured was carried to the hospital.
The petitioner is a person of clean antecedent. He is under custody since 24.04.2022.
Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st Saran at Chhapra in connection with Ekma (Akma) P.S. Case No. 157 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
